About this Form: This is a no-fault divorce form for use within the State of New York (COMPLAINT FOR DIVORCE). Most courts will require that this form be completed and filed along with a Marital Settlement Agreement (Minor Children). Please note that in Paragraph 5 (Grounds for Divorce), the Plaintiff will need to specify grounds for divorce that are recognized as valid within the State of New York. New York law recognizes only the following grounds as sufficient for granting a no-fault divorce: (1) living separate and apart for one year under the terms of a Separation Agreement that is in writing and notarized (Note: proof of compliance with the terms of the Settlement Agreement must be submitted when the divorce is filed; and a brief memorandum of the agreement must be filed in the office of the clerk of the county in which the divorce is sought.); or (2) living together and apart for one year under the terms of a judicial separation decree.
